This course presents
the problem of codifying the customary and jurisprudential rules in the Kingdom
through the study of the scientific origins of the legalization. This course also
clarifies the meaning, methods of the legalization, the history of SHARI’AH codes, its role in legal development
and the contemporary development of legal codes. The course moreover studies of
previous codification attempts in the Islamic and Western worlds and commenting
on each of the codes that resulted from the codification movement. Afterward,
the course will discuss the analysis of the movement of codification in the
Kingdom to evaluate it and to determine the feasibility, advantages, disadvantages
and difficulties encountered it.
